RELEASE AND WAIVER OF ALL CLAIMS AND ASSUMPTION OF RISK

The undersigned, in consideration of being allowed to attend the NYINGMA SUMMER SEMINAR  (“Program”) at PHUNTSOK CHOLING, 45640 HWY 72, WARD, CO, 80481, (“Premises”), hereby assumes all risks of injury to my person and property that may be sustained on the Premises (or on the access road or on the surrounding lands of Premises).

I hereby, for myself, my heirs, successors, executors, administrators and assigns, release, forever discharge, and agree to hold harmless, Mangala Shri Bhuti, a Colorado non-profit religious corporation, the owner and operator of Premises, together with all its personnel including without limitation, its officers, directors, teachers, agents, employees, servants, members, speakers, and others performing functions in connection with the operations and maintenance of Premises and the administration and hosting of the Program, together with all other persons participating in the Program and the owners of property contiguous to the Premises through or on which I may pass (collectively the “Released Parties”) from all claims, liabilities, obligations, promises, agreements, demands, right of actions or causes of action of any sort, known or unknown, for personal injury, sickness, disability, death or damage to personal property sustained to my person and/or property during my presence at Premises and my participation in the Program (collectively “Claims”).  I further agree to waive all such Claims, and to indemnify, defend and hold harmless each of the Released Parties from and against any and all Claims of any sort whatsoever arising out of, or related to, my participation in, and attendance at, the Program.

By signing below, I acknowledge, and assume all risks associated with, my attendance of the Program and my presence at Premises (and surrounding lands) and further acknowledge that all my activities related thereto are voluntary. I am knowingly assuming the risks of attendance at the Program in a remote rural location, which risks include, without limitation: i) potential for serious injury, ii) great distance from medical care and emergency services  and no professionally trained medical personnel on the Premises; iii) rustic accommodations in a forested, undeveloped environment with rough, wooded terrain, unpredictable weather and temperature; iv) limited communications during the Program; v) possibility of injury as a result of participation in ‘rota’ and/or ‘work period’ and other support and maintenance activities while at Premises; and vi) other risks too numerous and difficult to enumerate associated with the activities I am voluntarily undertaking.

I hereby consent to receive medical treatment, if available, that might be deemed advisable in the event of injury or illness during the Program.

I understand that at this Program and related activities, I may be photographed and I agree to allow my photo, video or film likeness to be used for legitimate purposes by Mangala Shri Bhuti and waive any right or claim to compensation for such use, and waive any right that I otherwise might have to limit such use.

I acknowledge that I am not an employee or agent of Mangala Shri Bhuti, or any of the Released Parties.
